Alan Tunkel

Alan has a traditional chancery practice and specialises in both litigation and non-contentious work with a bias towards property-related matters.

He is frequently consulted as a ‘trouble-shooter’ by conveyancing solicitors when problems arise in apparently non-contentious matters.

He is widely instructed in all types of property litigation, including contract and conveyancing disputes, rent reviews, lease renewals, dilapidations and leasehold enfranchisement.

Alan also acts in property-related professional negligence claims.

Allied to his property work, Alan has a significant practice in building construction disputes, pursuing them by litigation, arbitration or mediation, as appropriate.

His other main areas of work are will and probate disputes, Inheritance Act claims and problems in private or charitable trusts.

He has acted in a number of cases where a former cohabitee is claiming a substantial share of their home by way of constructive trust.

Alan is instructed directly by accountants, for example in relation to back-duty claims and the preparation of suppression reports and on issues arising from personal or corporate insolvency.

Alan’s recent cases include:

  • Williams v Wilmot (LTL 19/6/2012): The Court inferred that a testator lacked testamentary capacity notwithstanding the presence of a contemporaneous medical report which opined that the testator had mental capacity to make a will.

  • Rosebery Ltd v (1) Rocklee Ltd (2) Eaglestone Investments Corporation and Eaglestone Investments Corporation v Rocklee Ltd, LTL 2/2/2011: Real property - landlord and tenant airspace, multiple occupation, roofs, tenant's rights and underleases, grant of roof by underlease, tenant's right to airspace above roof.

  • Fieldman v Markovitch [2001] All ER (D) 42 (Jul) Ch D, The Times, 31st July 2001, involving the issue of jurisdiction.

  • Asif v City (Europe) plc [2002] All ER (D) 193 (Jun) Ch D. The duty of care owed by a valuer to a mortgagor of property.

  • Lee v Lee [1999] BPIR 926 (Court of Appeal). The disclaimer of a lease by a trustee in bankruptcy.

  • Herkanaidu v Lambeth London Borough Council [1999] All ER (D) 1420, The Times, 28th February 2000. A conveyancing dispute involving a property sold by the Council at auction.

Education and career


Alan Tunkel read Physics and Jurisprudence at Oxford University and subsequently taught law at The City University.

He was formerly an Examiner of Title on first registration for HM Land Registry.
