James Gibbons

James has a commercial and Chancery practice which is predominantly litigation based, involving Civil fraud and asset recovery, Insolvency and corporate recovery, Director’s duties, Shareholder disputes and agreements, Minority actions including unfair prejudice and derivative actions, Partnership, Professional liability of accountants and solicitors, Trade secrets and Confidential information.

He is also instructed in all types of Employment disputes including wrongful and unfair dismissal claims, breach of duty by directors, breach of confidence and restraint of trade and related pre-emptive remedies, regularly advising employers, employees, directors, partners, vendors and purchasers of businesses.

  • Ticketout Ltd 2008 [2008] EWHC 3325 (Ch). Contempt of court.

  • Khatib v Ramco International (High Court, Chancery Division). Striking out following unless order.

  • Lexi Holdings Plc v Luqman [2007] EWCA Civ. 888 (Court of Appeal). Standard of proof in making unless order.

  • Official Receiver v Rangos (2006) (High Court, Chancery Division). Misfeasance.

  • Secretary of State for Trade and Industry in re Get Me Tickets Ltd [2006] EWHC (Ch). Winding up on grounds of Public Interest.

  • Gold v Curtis [2005] WTLR 673. First reported case under Inheritance Act by adult child with no moral claim.
