Charlotte is developing a busy and varied commercial and traditional Chancery practice and is regularly instructed in all areas of Chambers' work including contentious and non-contentious trusts and equity matters (including asset recovery, private-client and corporate trust-related disputes), general commercial and contractual disputes, wills and probate, insolvency, pensions (particularly dispute resolution) and taxation.

  • Court Experience

    Charlotte has wide litigation experience for her call, including several multi-day High Court and County Court trials, appeals, contested interim applications including disclosure and injunction applications before High Court and Circuit judges and matters before Masters and in the Companies Court. She has experience of acting as sole and junior counsel.

  • Drafting and Advisory Work

    Charlotte's practice also involves a broad range of drafting and advisory work, particularly in relation to taxation law, in which she has a particular interest. Charlotte is frequently instructed to advise on tax planning and after-the-event disputes and has advised private individuals, companies, and charitable and religious bodies.

    As part of her tax practice Charlotte is happy to undertake or advise on the drafting of trusts, wills, asset transfer agreements and similar documents.

  • Recent Cases

    Charlotte's recent and reported cases include:

    Traditional Chancery:

    • In the matter of M [2009] WTLR 1791. Charlotte represented a number of national charities in an application for the execution of a statutory will on behalf of M. One of the first reported cases on the effect of the "best interests test" under MCA 2005 on the statutory wills jurisdiction. Instructed by Withers LLP.
    • Re Sinclair (2008): Appeared for the successful trustee in bankruptcy in a two-day High Court trial to determine the bankrupt's interest in the matrimonial home, raising issues of constructive and resulting trusts and equitable charges.
    • Appeared and advised on several contested applications for the removal of personal representatives and the approval of executors' accounts as well as claims in devastavit and breach of fiduciary duties.
    • Charlotte frequently advises on and is currently instructed in a number of cases under the Inheritance (Provision for Family and Dependants) Act 1975, several of which also involve proprietary and equitable claims.

    Commercial and commercial Chancery:

    • Secret Hotels 2 Ltd v EA Traveller Ltd [2010] EWHC 1023 (Ch): the effect of set-off under English law on the operation of Articles 27 and 28 of the Judgments Regulation.  
    • Acted in 2009 (with leading counsel) for a family company in a claim for repayment of a loan from the estate of a deceased shareholder. The case settled before trial.
    • Cronk v Farley (2009) Charlotte appeared for a director of the bookmakers Coral Racing in his successful application for an injunction restraining the defendant from harassing members of Coral's staff. Instructed by Blake Lapthorn LLP.
    • Kidort Ltd v Grant Thornton LLP (2008/2009). Acted for Grant Thornton as administrative receivers of Kidort Ltd in an application by the company for disclosure of documents for the purposes of its ongoing litigation with Nat West. Instructed by Grant Thornton's in-house legal department.
    • Stott v Coral Racing (2008) Charlotte appeared on behalf of Coral Racing in its successful application to have a claim for payment on a disputed betting slip struck out. Instructed by Blake Lapthorn LLP.
    • Numerous insolvency-related matters in the Companies Court including injunctions restraining winding up petitions, contested applications for the appointment of administrators and misfeasance and wrongful trading applications.
    • A number of unfair prejudice petitions under s 994 of the Companies Act 2006 (previously s 459 of the 1985 Act) including claims for misappropriation of assets by directors.

    Before coming to the Bar Charlotte read Philosophy, Politics and Economics at the University of Oxford, where she was made a Scholar of Brasenose College on the basis of academic achievement.
